The lead suspect in the shooting death of D12’s Proof was arraigned on a pair of weapons charges at the 36th District Court in Detroit on Saturday (April 15) and remains jailed.
Detroit bouncer, Mario Etheridge, is charged with "Carrying a Concealed Weapon and Discharge of a Firearm in a Building" in the shooting that left Proof dead and another man critically injured early last Tuesday morning (April 11). Randall Upshaw, Etheridge’s lawyer, entered not guilty pleas on his client’s behalf on Saturday and a preliminary hearing in the case has been scheduled for Wednesday, April 26.
If convicted, Etheridge faces a maximum of nine years in prison - five years on the concealed weapon charge and four years on the discharging a firearm count. Upshaw is staying consistent in his belief that the shooting of Proof was an act of self-defense.
“If it wasn’t for Proof trying to harm someone, we wouldn’t be here today,” Upshaw told the Associated Press.
Witnesses have told the Detroit police that Etheridge shot Proof after the D12 MC shot Army veteran, Keith Bender Jr. Since the fatal shooting, it has been confirmed that Etheridge and Bender are cousins. Wende Berry, spokeswoman of St. John Hospital, told the AP that Bender was still in critical condition on Saturday.
The Wayne County prosecutor’s office said that without the weapons charges, authorities would have had to release Etheridge.
Meanwhile, a public viewing for Deshaun "Proof" Holton will be held tomorrow while his funeral is scheduled for Wednesday (April 19).
