Shyne’s Supreme court case will be postponed for at least 30 days till a new judge is appointed.
That’s because Judge Howard Ruditzky stepped down from presiding over the case Monday morning (March 20) at Kings County Supreme Court in Brooklyn, N.Y, after it was revealed that the same Dershowitz and Dershowitz law firm that previously represented Shyne, also represented the Judge’s brother-in-law, which might cause a conflict of interest.
That leaves Moses Michael Leviy, aka Shyne, and his current attorney, Oscar Michelen, patiently waiting for a new judge to be appointed, a legal process that is anything but speedy.
“It takes 30 days for a new judge (to be appointed). Everything takes time in the legal system,” Michelen told Vibe.com during an exclusive phone interview on Monday afternoon. “We’re going to write a letter together to let the court know we’re ready for a new judge as soon as possible.”
When the case resumes, Michelen will still be requesting the motion to free money belonging to Shyne, so the former Bad Boy MC can use it to support his family.
The plaintiffs’ attorneys are alleging that Shyne has spent some of his frozen assets already.
Friday, March 17, 2006 marked the 5th year of incarceration for Shyne, who started his 10-year sentence for the shooting incident at Club NY in 1999.
