Eminem has been given the US court's go-ahead to continue his suit against Apple, its advertising agency TBWA/Chiat/Day and MTV.

Though some claims in the case were disallowed the artist can press on with the suit, which alleges the defendants broke federal copyright law and falsely implied the artist had endorsed Apple's iTunes Music Store and iPod.

An MTV Apple TV advertisement in the US had featured a ten-year old singing Eminem's track, Lose Yourself. Two claims of unfair competition and unjust enrichment were rejected, reports the Detroit News. The ad was screened for three months beginning July 2003, and was also made available on Apple's Web site.

However, despite the personal intervention of Apple CEO Steve Jobs the computer company was unable to secure permission to use Eminem's song in its ad campaign.

Eminem's legal representatives have in the past said the artist would have required as much as $10 million to endorse any product, which he has never done.
